1. Acceptance of Terms
By using CIForge, you agree to be bound by these terms of service. If you do not agree to these terms, please do not use CIForge or any of its related websites.
We reserve the right, at our discretion, to change, modify, add or remove portions of these Terms periodically. Such modifications shall be effective immediately upon posting of the modified Terms to CIForge.com.
2. No Unlawful or Prohibited Use
By using CIForge, you warrant that you will not use CIForge, CIForge.com, or any content obtained from CIForge for any unlawful purpose or any purpose prohibited by these terms of use.
3. Responsibility of account
Each user that registers with CIForge will receive an account username and password that is used to access all sections of the site, including any hosted projects, and access to their repositories. The user is fully responsible for maintaining the confidentiality of this account and are fully responsible for any activities conducted with their account. The user much immediately notify CIForge of any unauthorized use of their account. CIForge cannot and will not be liable for any loss or damage arising from a users failure to comply with this section.
4. Licensing
CIForge requires that all code, images, and data posted to its repositories or posted as file releases is licensed under an OSI-approved license.
Any content or messages posted to other areas of the site such as the ticket trackers, wikis or any other message area remains under the ownership of the user that posted it. The user implicitly grants CIForge a royalty-free, perpetual, irrevocable, non-exclusive and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, all subject to the terms of any applicable approved license.
5. Storage
CIForge will make reasonable efforts to back up site data stored on CIForge-maintained services, and make data available in the event of a loss or deletion but maintains no responsibility or liability for failure to store any content maintained on any CIForge-maintained service or any service provided by a partner or affiliate.
CIForge maintains the right to remove any data on the site for any purposes, but will normally only do so if that content is proven to be infringing another copyright or not licensed according to the terms set out in section 4.
6. Termination
We may terminate a user's account at our discretion and for any reason. We are likely to terminate an account especially if:
- A violation of these terms of service
- Abuse of site resources or attempts to gain unauthorized entry
- A users request for termination
- Requirement of law, court or governing agency order
7. INDEMNITY
Each user shall indemnify CIForge, CIForge.com or any related website or service, partners and their respective agents and employees from any and all claims, demands, damages, costs and liabilities, including reasonable attorneys' fees, made by any third party due to or arising out of that user's acts or omissions, including claims arising out of that user's use of CIForge, his or her submission, posting or transmission of content or his or her violation of these terms.
8. Disclaimer of liability
USE OF CIFORGE IS AT EACH USERS OWN RISK. CIFORGE.COM AND CIFORGE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS AND CIFORGE ASSUMES NO RESPONSIBILITY FOR ITS AVAILABILITY, RETENTION OF DATA OR RELIABILITY.
IN NO EVENT SHALL CIFORGE, ITS AGENTS, SUBSIDUARIES, PARTNERS, USERS OR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH CIFORGE SERVICES, CONTENT OR THESE TERMS.
